Simple BreathworkTerms of Use
These terms cover the Simple Breathwork: Breath Hold app (the "app") and the simplebreathwork.app website (the "site"), operated by Daniel Gnecco ("we", "us"). By downloading or using the app or the site, you agree to these terms. If you don't agree, please don't use them.
1. The app license
The app is licensed to you under Apple's Licensed Application End User License Agreement (the "Standard EULA"). These terms add to the Standard EULA. If the two conflict on how the app is licensed, the Standard EULA wins. You may not copy, modify, distribute, reverse engineer or resell the app except where the law allows.
2. Health and safety
Simple Breathwork provides guided breathing exercises for general wellness. It is not a medical device and does not provide medical advice, diagnosis or treatment.
- Power breathing and breath retention can cause dizziness, tingling, light-headedness or fainting. Always practice seated or lying down in a safe place.
- Never practice in or near water (including baths, pools and the sea), while driving, operating machinery or standing, or in any situation where losing focus or consciousness could be unsafe.
- Talk to a doctor before use if you are pregnant or have a heart, blood pressure, lung, seizure, mental health or other medical condition.
- Stop immediately if you feel unwell, and breathe normally. Never push a breath hold past a strong urge to breathe.
You practice at your own risk. To the extent the law allows, we aren't responsible for harm that results from breathing exercises you choose to do. The same applies to the breath-hold timer and pacers on the site.
3. Free features and Premium
The app is free to download. Start Fresh and Box Breathing are free every day, with no account needed. Other features require Premium. Features may change over time.
Subscriptions
- Premium is an auto-renewing subscription, offered monthly or annually. On the US App Store on the date above, the prices were $5.00 per month and $30.00 per year. The App Store shows the current price for your country before you buy, and that price is the one that applies.
- Where a free trial is offered, it converts to a paid subscription unless you cancel at least 24 hours before the trial ends.
- Payment is charged to your Apple Account when you confirm the purchase. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends.
- Manage or cancel any time in iOS Settings → your name → Subscriptions. Deleting the app does not cancel a subscription.
- Refunds are handled by Apple under its policies at reportaproblem.apple.com.
4. Acceptable use
Don't misuse the app or the site, interfere with how they work, try to access them other than through the interfaces we provide, or use them in violation of any law.
5. Availability and changes
We may update, change or discontinue features. We'll make reasonable efforts to keep the app working, but we don't promise uninterrupted availability. We may update these terms; the date at the top shows the latest version.
6. Disclaimers and limitation of liability
The app and the site are provided "as is" without warranties of any kind, to the extent the law allows. To the extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, including damages related to the practice of breathing exercises, and our total liability for any claim is limited to the amount you paid for the app in the 12 months before the claim. Nothing in these terms limits rights you have under consumer law that can't be waived.
